Assisted Living Rules and Regulations in South Dakota

Consumers often rely on information provided by state regulatory agencies to make educated decision in senior care. However, public access to assisted living records like violations, complaints, survey results and inspection reports differ depending on the state. Here’s a snapshot of how transparent the state of South Dakota is with assisted living records.

Public Records and License Status

South Dakota provides very limited access to assisted living records. They provide a PDF online which lists licensed assisted living communities but does not have information about inspections, violations or complaints available online.

To access information about assisted living communities, contact the Department of Health. For more detailed information, consumers can contact a local long-term-care ombudsmen using www.eldercare.gov. Consumers can also make a request for more information through the Freedom of Information Act.

Violations and Resident Protection

South Dakota does provide a list of licensed assisted living communities online and, while the information is current, it is not searchable. South Dakota provides survey reports for nursing homes only online.

They provide information about special licensing for care, capacity information and contact name. They do not provide information about payment types accepted at a facility or the price of a facility.

South Dakota conducts inspections annually but does not have the ability to fine a community for violations.
